1. Website and App Usage

By using Triptelligent's websites and apps (triptelligent.com, shorefox.com; the "websites/apps"), you agree to be legally bound by these terms, which shall take effect immediately.

Please do not access and/or use the websites/apps if any of the following are true:

  • You do not agree to be legally bound by all of the following Terms & Conditions.
  • You are under 18 years of age.
  • You do not have the legal authority to enter into a binding agreement.
  • You are booking on behalf of an individual without full authority to enter him into a binding agreement on his behalf.
  • You have not read all of the terms and conditions contained herein.

Triptelligent may amend, alter, and change these Terms & Conditions at any time by posting changes on the websites/apps. Please review these Terms & Conditions regularly to ensure you are aware of any changes made by Triptelligent. Your continued use of the website/apps after changes are posted means that you agree to be legally bound by these terms as updated and/or amended. No modification to these Terms & Conditions will be binding on Triptelligent unless authorized in writing signed by an authorized officer of Triptelligent or posted on the websites/apps.

You are prohibited from copying, reproducing, republishing, downloading, posting, broadcasting, transmitting, making available to the public, or otherwise using the website's/app's content (including text, images, URLs, pricing information, etc.) in any way except for your own personal, non-commercial use. Any other use of the website's/app's content requires the prior written permission of Triptelligent.

You agree to use the websites/apps only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of the website/app.

Your use of the websites/apps is intended for personal, noncommercial use and/or to make legitimate requests to book the products or services offered. You agree not to use this websites/apps to make any speculative, false or fraudulent requests. You agree that all information you provide will be true, accurate, current and complete.

You agree not to use robots, spiders or other automated means to access the websites/apps, unless specifically permitted in writing by Triptelligent.

You agree not to bypass or circumvent measures employed to limit or prevent access to the websites/apps, to "frame" or "mirror" any part of the websites/apps into any other websites/apps, or to "deep-link" directly to any portion of the website, including the purchase path for any shore excursions.

Although Triptelligent will seek to keep the website/apps accessible and secure at all times, Triptelligent makes no warranty as to the uninterrupted accessibility or security of the websites/apps.

These websites/apps may contain links to third-party websites not owned by Triptelligent. Triptelligent has no control over, or responsibility for, any such websites. Triptelligent affirmatively disclaims any responsibility for representations made by other websites linked herein, and further disclaims any obligations to promises, contracts, or advertisements made by those websites/apps.


2. User Accounts

You have the option to create an account and provide information about yourself in order to use some of the features on the websites/apps. You are responsible for maintaining the confidentiality of your account password. You are also responsible for all activities that occur in connection with your account. You agree to notify Triptelligent immediately of any unauthorized use of your account. If you store any information related to your Triptelligent account on a mobile device or computer, you agree to delete any such information before transferring the device to a new owner. You agree not to store any such information on a public computer or in any other place where it can be accessed by others.

Your account is for personal, non-commercial use only. You may not impersonate someone else (e.g., adopt the identity of a celebrity), create an account for any other person, provide an email address other than your own, or create multiple accounts.

Triptelligent reserves the right to close your account at any time for any or no reason, at its sole discretion.


3. Shore Excursion Basics

All shore excursions, content and prices are the sole design and designation of the individual tour operators. Triptelligent provides a connection platform where these tour operators can sell their shore excursions to customers. As such, Triptelligent does not validate or verify the shore excursion content or the quality of the excursion. Similarly, Triptelligent disclaims all such responsibility.

The shore excursion descriptions are based solely on the content provided by the tour operator and Triptelligent has no responsibility for the accuracy of excursion descriptions.

A tour operator may decide to offer both adult and child prices based on the age ranges that the tour operator designates for a child. The age of a person will be determined by the date of the shore excursion selected. It is the responsibility of the guest to make appropriate adult and child reservations based on the ages of the guest's group members and the age ranges designated by the tour operator.

For most shore excursions, there is no minimum age for children as long as they are accompanied by a parent or guardian. It is your sole responsibility to book only shore excursions for you and all members of your party, and to comply with any age restrictions.

Guests under the age of 18 years are not permitted to participate in any shore excursion without a parent or guardian.

It is the guest's responsibility to verify that tour operators are in compliance with any licensing or insurance requirements. Triptelligent disclaims all responsibility for tour operators' compliance with such requirements.


4. Booking Process

The booking deadline for each shore excursion is defined by the tour operator and is measured against the timezone of the location of the shore excursion, and will be updated in real time on the websites/apps.

All booking requests must be submitted with valid payment information. When paying for a shore excursion with a credit card, you confirm that you are the authorized cardholder or that you have been authorized by the cardholder to use the credit card for this purpose. In the event that the credit card is dishonored, rejected or later contested for any reason, you agree to pay the amount indicated on the booking confirmation page to Triptelligent. Triptelligent reserves the right to cancel your booking if payment is not received in a timely fashion.

All prices and availability will be confirmed to you within 48 hours. If the shore excursion is within the next 48 hours, the booking will be processed as quickly as possible but no guarantee can be given that the shore excursion will be booked.

You will be charged in full for the shore excursion when the tour operator confirms the booking request. A confirmation PDF will be sent to you at the e-mail address you provide within 24 hours following payment for the shore excursion. The PDF will include a receipt for the purchased shore excursion, the tour operator confirmation code and a description of the purchased shore excursion. Depending on the booking channel, you may alternatively or additionally receive an in-app notification about the booking status.

Triptelligent charges in three currencies: US Dollar, Euro, or British Pound, according to the currency that the tour operator has specified. An appropriate conversion, completed by your credit card company, to your home currency at the time of booking is shown. Credit card charges may differ slightly based on time of credit card company charge.


5. Physical Requirements

The physical requirements of the participants of each shore excursion and the overall conditions of the excursion, including transportation to and from the excursion, are specified individually by the tour operator in the description on the websites/apps.

Triptelligent does not validate, verify, inspect or otherwise determine the physical requirements for participating in any shore excursion as specified by the tour operator, nor does Triptelligent validate the physical ability of any guest making a booking request to participate in a shore excursion.

It is your responsibility to affirm that you and all members of your party understand and are able to meet the physical requirements prior to completing the booking request. Triptelligent takes no responsibility for checking or validating, verify, inspect or otherwise determine the physical health of any guest, nor any guest's ability to participate in a shore excursion.

All participation is at the sole decision of the guest and Triptelligent is not liable for any health concerns or complications that result from a shore excursion.


6. Right of Refusal

A tour operator has the right to refuse service to any guest for any lawful reason.

If a tour operator refuses service to a guest, no refund will be offered.

Triptelligent is not responsible for a tour operator's refusal of any service, nor is Triptelligent responsible for any financial loss, inconvenience or other damages as a consequence of a tour operator's refusal of service.


7. Cancellation / Refund Process

You can cancel a booking for a full refund up to 7 days before the shore excursion is scheduled to take place. This is measured against the start of the day of the shore excursion in the local time zone where the shore excursion is to take place.

No refunds will be offered for any cancellations that occur within 7 days before the shore excursion is scheduled to take place.

No refunds will be made to any guest who fails to show up for a shore excursion departure at the designated time and place, or who leaves, or otherwise does not use all of the services scheduled to be provided by a shore excursion.

Most shore excursions will operate in a variety of weather conditions, and no refunds will be made to any guest who chooses not to participate in a shore excursion due to weather conditions.

Members of any excursion who elect to leave the designated shore excursion transportation must provide their own transportation at their own expense back to the landing place of the ship.

Triptelligent reserves the right to cancel confirmed shore excursions. While we expect this to happen very rarely, a full refund will be paid if this occurs.

If the ship does not arrive to the port of call for whatever reason, the shore excursion will be fully refunded. It is your responsibility to notify Triptelligent in writing of the circumstances within 7 days of the scheduled shore excursion departure and request the refund accordingly.

If the ship is delayed in arrival and clearance to the port so that you cannot make the scheduled shore excursion, the excursion may be refunded to you only if you adhere to the following requirements:

  1. You must notify Triptelligent within 7 days of the missed shore excursion.
  2. You must provide Triptelligent any supporting documentation required for their investigation.

If the shore excursion cannot take place due to weather, or an equipment problem prevents the tour operator from providing the shore excursion, a full refund may be issued at Triptelligent's sole discretion.

Any other requests for refunds, while unlikely, will be decided on a case by case basis and shall be decided using the sole discretion of Triptelligent.

Occasionally tour operators and/or service providers make changes to shore excursion dates, prices, inclusions, coverage, age requirements, etc. As a result, Triptelligent reserves the right to cancel, change or substitute any service, shore excursion, ticket or product that you have booked at websites/apps, at any time, for any reason.

In such cases, if you are dissatisfied with the alternatives offered, you may be entitled to a full refund of the original purchase price.

Notwithstanding the above, when we are informed in advance by tour operators and/or suppliers of a significant change to a booking and/or to a shore excursion, we make every reasonable effort to work with you, in order to amend or re-issue the booking where feasible.

For all excursions that include activities with or trips to see wildlife, including but not limited to whale watching, bird observation, sea turtle snorkeling, penguin watching, stingray swimming, brown bear watching etc., we make no guarantee the you will see these animals during your tour as the animals are living in their natural habitat and are not fenced. We do not allow for refunds in the case that you don't see the animals during your excursion.


8. Personal Items

All personal items, including coats, cameras, phones, handbags, and similar personal articles should remain at all times throughout the shore excursion under the personal control of the guest.

Triptelligent is not responsible for the loss, theft, or damage of personal items while a guest is on a shore excursion.


9. Missing the Ship

Triptelligent is not responsible if you are not returned to the ship in time to board.

If you are not returned to the ship in time to board for any reason, you will need to make arrangements to meet the ship at the next port of call.

If you are not returned to the ship in time to board due to the fault of the tour operator or the tour operator's equipment, receipts related to the travel to the next port of call to join the ship can be submitted for reimbursement up to a maximum value of US $500 per person.

All receipts for transportation, meals and lodging must be retained and submitted for reimbursement to Triptelligent within 7 days. Triptelligent reserves the right to determine fair and reasonable reimbursement for expenses incurred based on receipts submitted.

This reimbursement policy applies only to our contracted local suppliers and only when, through no fault of action of you or any member of your party, you are not returned to the ship in time to board.

This reimbursement policy does not apply in instances where delay is caused by your own actions and/or you have deviated from the Triptelligent activity or shore excursion. You must supply Triptelligent with correct arrival and departure ship information and ensure there is enough time (a minimum of 2 hours) between the shore excursion end time and the ship departure time.


10. Content

Triptelligent will provide all customers who complete a shore excursion the opportunity to provide feedback in the form of a rating or a written review, or both. You should not make false or misleading statements in any written review, nor should you accept any discount or other incentive from a tour operator to provide a more favorable review.

By submitting any content to the websites/apps (whether by e-mail, uploads, posting reviews or photographs, or any other medium and whether a review or any other content), you grant Triptelligent a nonexclusive, royalty-free, perpetual, transferable, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, translate, distribute, publish, create derivative works from and publicly display such submission in any medium and any location. Triptelligent (and its sublicensees/transferees) may choose to use the name you provide with your submission, at its discretion. Triptelligent has the right to publish, not publish, or remove any content you submit without notice to you. Triptelligent takes no responsibility and assumes no liability for any submissions provided by you.

You are solely responsible for any content you submit. You may not submit any content to the websites/apps that is:

  • Threatening, libelous, defamatory, obscene, pornographic, or in violation of any right of publicity/privacy or any other law
  • Commercial material or content (including soliciting funds and advertising any goods or services)
  • In violation of any third party's copyright, trademark, patent, or other property right

You shall be solely liable for any damages resulting from any violation of these requirements or any other harm resulting from your submission to the websites/apps and shall fully indemnify Triptelligent (and its sublicensees/transferees) for any resulting claims.

If you do not agree to these conditions, please do not submit any content to the websites/apps.


11. Communication Services

Triptelligent may make email, messaging, push notifications, blogging or chat/text message services and other communication options to users of our websites/apps.

Mailboxes and other message storage services provided on the websites/apps may have a limited storage capacity. If you exceed the maximum permitted storage space, automated devices may delete or block messages that exceed the limit. Triptelligent will not be responsible for such deleted or blocked messages.


Except as expressly provided in these Terms & Conditions, Triptelligent makes no warranties (including implied warranties) or representations (including as to the accuracy or completeness of any information about any shore excursion, or the quality of any products or services) as to any customer and disclaims all liability for any damages, direct or consequential, that may arise from use of the websites/apps or any shore excursion sold through Triptelligent.

You agree to indemnify and defend Triptelligent, and each of its officers, directors, employees and agents from and against any claim, cause of action or demand, including reasonable legal and accounting fees, in any action filed or commenced by any third party against Triptelligent as a result of:

  • Your breach of these Terms & Conditions
  • Your violation of any law or the rights of any third party
  • Your use of the websites/apps

You agree that any and all disputes, claims, and causes of action arising out of, or connected with, your use of the websites/apps or these Terms & Conditions, shall be resolved exclusively, and without resort to any form of class action, by the appropriate courts in Miami - Dade County, Florida.


13. Price Discounts and Deals

Triptelligent may choose to publish discounted tours or deals on its website or app. All reservations are subject to availability by the tour guide. Price discounts are only valid for the 24 hour time period noted. Price discounts or deals cannot be applied to existing reservations.
